1. TERMS OF SERVICE

1.1 Acceptance of These Terms

Welcome to Du Monde Winery ("Du Monde," "we," "us," or "our"). By accessing or using our website (the "Site"), creating an account, joining a membership/allocation program, or purchasing products, you agree to be bound by these Website Terms and Policies (the "Terms").

If you do not agree, do not use the Site.

These Terms are a legally binding agreement between you and Du Monde Winery, a business based in British Columbia, Canada, operating under a manufacturing license.

1.2 Eligibility (19+ Only) and Legal Compliance

You must be at least 19 years old (the legal drinking age in British Columbia) to access or use the Site, create an account, join a membership/allocation program, or purchase alcohol products from us. By using the Site, you represent and warrant that you are 19+.

We may require proof of age at any time (including at checkout and/or delivery). If you cannot provide valid identification, we may cancel your order, refuse delivery, suspend or terminate your account, and/or restrict access to the Site.

You are responsible for complying with all laws that apply to you, including laws related to alcohol purchase, possession, and delivery.

1.3 Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted with an updated "Last Updated" date. Your continued use of the Site after changes are posted means you accept the updated Terms.

1.4 Permitted Use of the Site

You may use the Site for lawful purposes only. You agree not to:

  • Provide false, inaccurate, or misleading information
  • Impersonate any person or entity
  • Interfere with Site operation or security
  • Attempt unauthorized access to any systems or data
  • Use bots, scrapers, or automated tools to access or collect data without our written permission
  • Violate any applicable laws or regulations

1.5 Account Creation and Security

Some features require an account. When you create an account, you agree to provide accurate and up-to-date information and to keep it current.

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately if you believe your account has been compromised.

We may suspend or terminate accounts that we believe are being used fraudulently or in breach of these Terms.

1.6 Products, Services, and Limited Allocation Releases

Du Monde is a globally positioned wine house. We source, import, finish, curate, and release premium wines from renowned wine regions around the world, including limited allocation releases that may sell out quickly and may be offered only to eligible members or customers.

Product descriptions, tasting notes, imagery, vintage information, and availability are provided for convenience and may change. We do not guarantee that content is accurate, complete, or error-free.

We may:

  • Limit purchase quantities (including per customer, per household, or per release)
  • Refuse orders at our discretion to the extent permitted by law
  • Cancel orders due to inventory issues, pricing errors, suspected fraud, compliance concerns, or other legitimate reasons

1.7 Orders, Pricing, Taxes, and Payment

Pricing & Currency. Prices are shown in Canadian Dollars (CAD) unless stated otherwise and may change at any time.

Taxes & Fees. Applicable taxes, bottle deposits (if any), recycling/environmental fees (if any), duties (if any), and shipping/handling are added at checkout.

Payment. We accept the payment methods shown at checkout. By providing payment information, you authorize us (and our payment processors) to charge the full amount of your order, including taxes and fees.

Order Acceptance. Your order is an offer to purchase. We may accept, reject, or cancel your order (including after an order confirmation) where permitted by law. If we cancel after charging you, we will issue a refund to the original payment method.

1.8 Shipping, Delivery, and BC Liquor Law Compliance

Alcohol shipments are subject to strict legal requirements. We comply with applicable British Columbia liquor laws and any other applicable laws governing the sale and delivery of alcohol.

Where We Ship. We only ship where permitted by law and may restrict shipments by province/territory, country, postal code, or carrier route. We may update shipping eligibility without notice.

Recipient Requirements.

  • Adult signature is required at delivery (19+ or older as required by law)
  • Government-issued photo ID may be required
  • Delivery may be refused if the recipient cannot prove age, appears intoxicated, or otherwise does not meet legal delivery requirements

Address Accuracy. You are responsible for providing a valid and accurate delivery address. Failed delivery attempts, re-routing, storage, return-to-sender, or re-shipping fees may be charged to you to the extent permitted by law.

Risk of Loss. Risk of loss transfers to you upon successful delivery to the address you provided (subject to any mandatory consumer protection rules that apply).

Timeframes. Delivery estimates are not guarantees. We are not responsible for delays caused by carriers, weather, customs, regulatory processes, or other events outside our reasonable control.

1.9 Returns, Refunds, and Cancellations (Alcohol)

Because alcohol is regulated and perishable, all sales are generally final except where required by law or where we approve a remedy under this section.

We may provide a replacement or refund (our choice, where permitted) if:

  • The product arrived damaged (e.g., broken bottle)
  • You received the wrong product
  • The wine is demonstrably flawed (e.g., cork taint/oxidation), assessed in good faith

Claims Window. Contact us within 7 days of delivery and include order details and photos (and, for wine faults, any details we reasonably request).

Cancellations. If your order has not been processed/packed, you may request cancellation within 24 hours of placement. Once packed or shipped, cancellation may not be possible.

Refund Timing. Approved refunds are issued to the original payment method within 14 business days. Shipping charges are non-refundable unless the issue was caused by us.

1.10 Memberships, Allocation Programs, and Marketing Opt-Ins

Du Monde may offer memberships, allocation access, waitlists, founder programs, or similar offerings ("Programs"). Program benefits, eligibility, pricing, purchase commitments, and release mechanics will be shown at signup or in Program-specific terms, which are incorporated by reference.

By joining a Program, you agree that:

  • Allocations may be limited, change over time, and may be subject to eligibility rules
  • Certain Programs may include recurring charges or minimum purchase commitments, disclosed at enrollment
  • We may communicate with you about Program administration (service messages)
  • Marketing messages are optional and can be managed via unsubscribe links or account preferences (see Privacy Policy)

We may terminate or suspend Program participation for non-payment, suspected misuse, fraud, or breach of these Terms or Program-specific terms.

1.11 Intellectual Property

All Site content (text, designs, graphics, labels, photos, logos, audio/video, and software) is owned by Du Monde or its licensors and is protected by intellectual property laws.

You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial use only. You may not copy, reproduce, distribute, modify, create derivative works, sell, or exploit any content without our prior written permission.

"Du Monde Winery" and "Du Monde" and associated logos are trademarks of Du Monde Winery. Unauthorized use is prohibited.

1.12 User Content (Reviews, Comments, Submissions)

If you submit reviews, comments, images, or other content ("User Content"), you grant Du Monde a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display such User Content in connection with our business and marketing, subject to applicable law.

You represent that:

  • You own or have permission to submit the User Content
  • The User Content is not unlawful, defamatory, obscene, or infringing
    We may remove User Content at any time.

1.13 Investment and Forward-Looking Statements (If Applicable)

Information about founder allocations, investor-backed growth, or similar opportunities is provided for informational purposes only and is not investment, legal, or tax advice. Consult your own advisors.

Any forward-looking statements are subject to risks and uncertainties. Past performance does not guarantee future results.

1.14 Disclaimers

Site Provided "As Is." The Site and content are provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.

Product Enjoyment/Responsibility. Drink responsibly. Do not drink and drive. If you have health concerns, consult a physician regarding alcohol consumption.

1.15 Limitation of Liability

To the maximum extent permitted by law, Du Monde (and our directors, officers, employees, agents, and service providers) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses arising from or related to your use of the Site or products.

To the maximum extent permitted by law, our total liability for any claim will not exceed the amount you paid for the specific product or service giving rise to the claim, or CAD $100, whichever is greater.

Some jurisdictions do not allow certain limitations; in that case, the limitations apply to the fullest extent allowed.

1.16 Indemnification

You agree to indemnify, defend, and hold harmless Du Monde and its directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms
  • Your violation of any law or third-party right
  • Your misuse of the Site or products
  • Your User Content

1.17 Dispute Resolution; Governing Law; Venue

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law rules.

You agree that any dispute arising out of or relating to the Site, these Terms, or purchases will be brought exclusively in the courts located in British Columbia, Canada, and you submit to their jurisdiction.

Where permissible by law, disputes may be resolved through binding arbitration in accordance with the rules of the British Columbia International Commercial Arbitration Centre.

1.18 Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (including acts of God, natural disasters, war, terrorism, labour disputes, government actions, pandemic, carrier disruption, customs/regulatory delays, or supply chain interruptions).

1.19 Severability

If any provision of these Terms is found unenforceable, that provision will be limited to the minimum extent necessary and the remaining provisions will remain in effect.

1.20 Entire Agreement

These Terms, together with any Program-specific terms and our Privacy Policy, are the entire agreement between you and Du Monde regarding the Site and supersede prior agreements on the same subject.

1.21 Waiver

Our failure to enforce any provision is not a waiver of our right to do so later.

1.22 Termination

We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms or where otherwise necessary to protect our business, customers, or legal compliance. Upon termination, your right to use the Site ends immediately.

1.23 Export/Import Compliance

You agree to comply with all applicable export and import laws and regulations. You may not purchase or export products in violation of Canadian laws or the laws of your jurisdiction.

1.24 Accessibility

We aim to make the Site accessible. If you have difficulty accessing any part of the Site, contact us and we will try to help.


2. PRIVACY POLICY

2.1 Scope and Overview

This Privacy Policy explains how Du Monde Winery collects, uses, discloses, and protects personal information when you visit or use the Site, create an account, make a purchase, join a membership/allocation program, or otherwise interact with us.

We operate in British Columbia, Canada. Our privacy practices are designed to comply with applicable Canadian privacy laws (including the Personal Information Protection Act (British Columbia), and where applicable, federal privacy laws).

2.2 Personal Information We Collect

Depending on how you interact with us, we may collect:

  • Contact details: name, email address, phone number, billing/shipping address
  • Account details: login credentials (stored in hashed form), preferences, purchase history
  • Age/eligibility verification: confirmation you are 19+; where required, ID check status (we try not to store copies of ID; if we must, we retain it only as long as necessary for compliance)
  • Transaction details: order details, payment confirmation (we do not store full credit card numbers; payment is handled by third-party payment processors)
  • Membership/Program details: allocation preferences, waitlist status, membership tier, benefits eligibility
  • Marketing and communications: email engagement, subscription status, referral codes, gift messages
  • Site usage data: IP address, device identifiers, browser type, pages viewed, approximate location, cookies and similar technologies
  • Customer support: messages, emails, chat transcripts, and call notes (if applicable)

2.3 How We Use Personal Information

We use personal information to:

  • Provide and operate the Site and your account
  • Process payments and fulfill orders
  • Verify eligibility (19+) and comply with liquor laws and delivery requirements
  • Provide customer service and order updates
  • Administer memberships, allocations, limited releases, waitlists, and related benefits

  • Send marketing communications (where you consent or as permitted by law), including new releases, limited allocations, events, and offers

2.4 Marketing Choices

You can opt out of marketing emails at any time by using the unsubscribe link in the email or by updating your account preferences (if available). Even if you opt out of marketing, we may still send you non-marketing service messages (e.g., order confirmations, legal notices, Program administration).

2.5 Cookies and Similar Technologies

We may use cookies and similar technologies to:

  • Keep you signed in (where applicable)
  • Remember preferences
  • Understand Site performance and usage
  • Support marketing and analytics

You can control cookies through your browser settings. Some Site features may not function properly if cookies are disabled.

Because we source wines globally and use third-party service providers, your information may be processed or stored in Canada or other countries. Those jurisdictions may have different privacy laws. We take reasonable steps to protect information regardless of where it is processed.

2.8 Data Retention

We keep personal information only as long as necessary for the purposes described above, including legal, tax, accounting, and regulatory requirements (including liquor-related compliance), after which we securely delete or anonymize it where appropriate.

2.9 Security

We use reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

2.10 Your Rights and Access

Subject to applicable law, you may request access to or correction of your personal information. You may also withdraw consent for certain uses (e.g., marketing), subject to legal or contractual restrictions.

2.11 Children

The Site is not intended for anyone under 19 years of age. We do not knowingly collect personal information from individuals under 19.
